Once finalized, a grant of Cancellation of Removal from an Immigration Judge results in lawful permanent resident or “green card” status for the applicant. It is an extremely limited and difficult form of relief to obtain from removal proceedings and only 4000 cases can be approved annually in the entire United States. It requires the applicant to prove several criteria, including: 1) more than 10 years of continuous presence in the U.S. prior to being placed into removal proceedings; 2) good moral character and a minimal criminal history; and 3) a very high level of hardship to a qualifying U.S. Citizen of Lawful Permanent Resident relative in the event of the applicant’s deportation.
